الشروط والأحكام

تنظم هذه الشروط استخدامك لنظام ميزا ERP وتطبيقه للجوال وموقع mizaai.net، المقدمة من ميزا (Miza). تاريخ السريان: 2026-10-07. باستخدامك الخدمة فإنك توافق على هذه الشروط.

1. الخدمة والاشتراك

ميزا ERP خدمة برمجية بنظام الاشتراك (SaaS). يحدد اشتراكك الباقة والوحدات وعدد المستخدمين والمدة. تتجدد الاشتراكات وفق الباقة المتفق عليها، ويجوز إيقاف الوصول عند انتهاء الاشتراك أو عدم السداد بعد إشعارك.

2. الحساب والمسؤولية عنه

أنت مسؤول عن سرية بيانات الدخول وعن كل نشاط يتم عبر حسابك وحسابات مستخدميك، وعن صحة البيانات التي تدخلها وعن التزامك بالأنظمة الضريبية والمحاسبية المطبقة على نشاطك.

3. الاستخدام المقبول

يمنع استخدام الخدمة في:

• أي نشاط مخالف للأنظمة أو لحقوق الغير.
• محاولة الوصول غير المصرح به إلى بيانات شركات أخرى أو اختراق الخدمة أو تعطيلها.
• الهندسة العكسية للبرنامج أو إعادة بيعه أو تأجيره دون إذن كتابي.
• رفع برمجيات خبيثة أو محتوى غير مشروع.

4. ملكية البيانات

تبقى بياناتك وسجلات أعمالك ملكا لك وحدك. نمنحك حق تصديرها في أي وقت خلال الاشتراك، ولا نستخدمها إلا لتقديم الخدمة وفق سياسة الخصوصية. وتبقى حقوق الملكية الفكرية في البرنامج والعلامة التجارية لميزا.

5. التوافر والصيانة

نسعى لتوفير الخدمة بصورة مستمرة، ولا نضمن خلوها من الانقطاع أو الأخطاء. قد نجري صيانة أو تحديثات، ونبذل جهدنا لإشعارك مسبقا بالأعمال المجدولة المؤثرة.

6. حدود المسؤولية

في الحدود التي يسمح بها النظام، لا تتحمل ميزا أي أضرار غير مباشرة أو تبعية أو خسارة أرباح أو بيانات، ويقتصر إجمالي مسؤوليتها عن أي مطالبة على قيمة الرسوم التي دفعتها خلال الاثني عشر شهرا السابقة للمطالبة. لا يخل ذلك بأي مسؤولية لا يجيز النظام تقييدها.

7. الإنهاء

يمكنك إنهاء الاشتراك في أي وقت وطلب حذف حسابك (صفحة /account-deletion.html). ويجوز لنا تعليق الحساب أو إنهاؤه عند مخالفة هذه الشروط بعد إشعارك متى أمكن.

8. التعديلات

قد نعدل هذه الشروط، ويظهر تاريخ السريان أعلى الصفحة. استمرارك في استخدام الخدمة بعد التعديل يعني موافقتك عليه.

9. القانون الواجب التطبيق

تخضع هذه الشروط لأنظمة المملكة العربية السعودية، وتختص المحاكم السعودية المختصة بالنظر في أي نزاع ينشأ عنها.

Terms of Service

These terms govern your use of the Miza ERP system, its mobile app and the mizaai.net website, provided by Miza. Effective date: 2026-10-07. By using the service you agree to these terms.

1. Service and subscription

Miza ERP is a software-as-a-service (SaaS) offering. Your subscription defines the plan, modules, number of users and term. Subscriptions renew according to the agreed plan, and access may be suspended after notice if the subscription ends or payment is not made.

2. Your account

You are responsible for keeping credentials confidential, for all activity under your account and your users' accounts, for the accuracy of the data you enter, and for your compliance with the tax and accounting rules that apply to your business.

3. Acceptable use

You may not use the service to:

• break the law or infringe the rights of others;
• attempt unauthorized access to other companies' data or to attack or disrupt the service;
• reverse engineer, resell or sublicense the software without written permission;
• upload malware or unlawful content.

4. Data ownership

Your data and business records remain solely yours. You may export them at any time during the subscription, and we use them only to provide the service as described in the Privacy Policy. Intellectual property rights in the software and the Miza brand remain with Miza.

5. Availability and maintenance

We aim to keep the service continuously available but do not guarantee it will be uninterrupted or error-free. We may perform maintenance or updates and will make reasonable efforts to notify you in advance of scheduled work that affects you.

6. Limitation of liability

To the extent permitted by law, Miza is not liable for indirect or consequential damages or loss of profit or data, and its total liability for any claim is limited to the fees you paid in the twelve months before the claim. This does not limit any liability that the law does not allow to be limited.

7. Termination

You may end your subscription at any time and request deletion of your account (page /account-deletion.html). We may suspend or terminate an account for breach of these terms, after notice where practicable.

8. Changes

We may amend these terms and will show the effective date at the top of the page. Continuing to use the service after an amendment means you accept it.

9. Governing law

These terms are governed by the laws of the Kingdom of Saudi Arabia, and the competent Saudi courts have jurisdiction over any dispute arising from them.
